On 30th October 2024, the Public Benefit Organizations Regulatory Authority (PBORA) held a Co-creation workshop with the support of USAID, KCDF, and UNDP whose aim was to establish a solid foundation for the successful implementation of the Public Benefit Organization.
The workshop developed an action plan for the successful implementation of the PBO Act, with clear roles and responsibilities for all stakeholders involved. Strategies for promoting collaboration and partnerships between the PBOs and government agencies were vividly discussed.
Speaking at the event, Mr. Lindon Nicholas, Acting Director General of PBORA, stated that the authority is focused on fully operationalizing the PBO Act while keeping the process transparent and participatory. He noted that the workshop is essential in bringing everyone on board to realize the Act’s
original vision. Mr. Lindon underlined PBORA’s goal as to complete the transition by May 15, 2025, aligning all stakeholders under the new framework.
Below is a summary of the structured steps for implementation that PBORA will follow:
- Formation of a Consultative Conference,
- Engagement of Consultants for Public Participation,
- Holding Public Forums in Clustered Counties,
- Plan for a Public Validation Forum and National Summit in Nairobi,
- Publication and Accessibility of the Draft Regulations for public access,
- Adhering to set timeline to Fast-Track Goals,
- Providing additional participation and online submissions to ensure all voices are heard,
- Incorporating Partner Events and International Interests,
- Team Formation for Broader Outreach.
Adding to the development geared to the successful implementation of the PBO Act, Ms. Kimberly Ludwig, Director of USAID/Kenya and East Africa Office of Democratic Governance, Peace and Security (DGPS), echoed that the new regulatory framework now offers CSOs an opportunity to bolster their sustainability strategies. She also added that civil societies have a unique role in promoting accountability and citizen-responsive governance as part of the governance agenda, contributing to a more inclusive, transparent system.
Ms. Kimberly emphasized the partnership between Kenya and the United States is founded on mutual respect and shared values, including the freedoms of association and expression. USAID remains committed to supporting the growth of Kenya’s civic space.
On her part, Ms. Grace Maingi, KCDF’s Executive Director, lauded the efforts made towards operationalizing the PBO Act, stating that KCDF’s interest in the Public Benefit Organizations (PBO) Act began well before 2013, as they sought to strengthen the enabling environment for civil society organizations (CSOs).
She further added that over the years, KCDF recognized the critical need for an environment that supports both civil society and the growth of philanthropy, including at the local and grassroots levels. This has fueled our involvement in the PBO Act and our support for organizations striving to ensure civil society can thrive while collaborating with the government. Ms. Grace further added that there will be weekly online meetings to discuss more on the PBO Act until it is gazetted.












During the meeting, stakeholders discussed potential solutions and identified these action points as the way forward:
- Finalize and validate the two draft regulations currently developed.
- Create a simplified, popular version of the PBO Act and draft regulations.
- Translate documents into English, Kiswahili, and sign language.
- Develop Frequently Asked Questions (FAQ) templates to educate the public.
- Create a code of conduct for federations and develop sector-specific codes.
- Appoint a Director General for the authority and publicize the position to encourage applications.
- Prepare for the appointment of new board members within the next 6 to 12 months, ensuring clear recruitment guidelines.
- Implement sensitization and capacity-building initiatives for PBOs regarding the new act and regulations within 12 months.
- Undertake a review of the NGO policy established in 2006, expected within 12 to 24 months.
- Promote registration for all existing organizations with the PBO authority to ensure compliance with the new regulations.
- Promote a collaborative environment that prioritizes collective goals over individual interests to ensure the success of the PBO Act implementation.
The Co-Creation Workshop marked a significant step forward in the implementation of the PBO Act, with collaborative efforts from various stakeholders highlighting a collective commitment to enhancing Kenya’s civic space. As PBORA moves toward its goal of full operationalization by May 2025, the emphasis on public participation, transparency, and partnership will be crucial.
This initiative promises to not only strengthen civil society but also contribute to a more accountable and responsive governance framework in Kenya. The concerted efforts of PBORA, USAID, KCDF, and UNDP demonstrate a shared vision for a thriving civic environment that benefits all Kenyans.
